An HOA is bound by its own:

 

• Covenants, Conditions & Restrictions (CC&Rs)

• Bylaws

• Rules & Regulations

If the HOA enforces rules inconsistently, or fails to follow proper procedures (e.g., notice of fines or architectural changes), owners can sue.
